In primo grado, a Travaglio era andata piuttosto male: otto mesi di carcere, inflitti dal giudice Roberta Di Gioia, scavalcando le richieste della Procura, che per il giornalista aveva chiesto la condanna a 500 euro di multa. Cinque mesi e dieci giorni erano stati inflitti anche a Daniela Hamaui, all’epoca direttore dell’Espresso. Entrambi i giornalisti avevano fatto appello. E l’8 gennaio 2010, la Corte d’appello di Roma aveva modificato la sentenza di primo grado. Sia Travaglio che la Hamaui erano stati di nuovo condannati, ma invece del carcere - pena che nei processi per diffamazione viene applicata con parsimonia, e solo nei casi più gravi - la Corte infligge a entrambi gli imputati una semplice multa: mille euro all’autore dell’articolo, ottocento al direttore responsabile.
